Website Terms of Use
These terms govern your use of this website. They are about browsing. If you go on to commission work, the separate Service Terms will apply.
1. Who operates this website
ARTinez is the trading name of Andrei Martinescu, a sole trader. The website is operated at artinez.co.uk and the contact address for all correspondence is office@artinez.co.uk.
2. What this website is
This website describes ARTinez's approach to design and development, shows selected work, and provides two ways to get in touch: a contact form and the ARTinez Vision builder.
Sending an enquiry — in any form, including through the Vision builder — does not create a contract. A contract arises only when you accept a written proposal from ARTinez, as described in the Service Terms and Conditions.
The ARTinez Vision builder generates an initial concept from the choices you make, using a fixed set of templates and wording that run entirely in your browser. It is a way to start a conversation. It is not a quotation, not a specification of work, not a statement of price, and not a guarantee that the finished website will look or behave in any particular way. The website it describes is an illustration only.
3. Content, ownership and what you may do
Unless otherwise stated, the content of this website — the text, design, code, images, the ARTinez name and logo, and the arrangement of the pages — belongs to ARTinez and is protected by United Kingdom and international copyright law.
You may:
- view the pages for your own private or internal business use;
- share a link to any page with other people;
- submit an enquiry through either form.
You may not, without written permission:
- reproduce the content, in whole or in substantial part, other than for your own internal use or for a link;
- use the ARTinez name or logo in a way that suggests endorsement or affiliation;
- publish the portfolio entries or the case studies as your own work.
The case studies shown describe work ARTinez carried out for other people and organisations. The brands and work shown belong to those clients, and ARTinez publishes them with their agreement. Their inclusion here is not a claim that the same approach, result or design would be reproduced for anyone else.
4. Enquiries and confidentiality
Please do not send confidential or commercially sensitive information through the free-text fields of the enquiry forms. They are not a secure way to transfer files or material you need to keep private, and they may be read on a mobile device or a shared computer.
Please also do not include passwords, access codes, payment card details, or any information you would not want us to hold. We will ask you to remove anything of that kind if you send it.
Once you are a client, confidentiality is dealt with in the written agreement between us.
5. Acceptable use
You may not use this website:
- in any way that breaks the law, or that infringes anybody else's rights;
- to send unsolicited bulk messages, or to attempt to send unwanted email through the enquiry forms;
- to probe, scan or test the vulnerability of the website or its underlying infrastructure without our written permission;
- to interfere with the website's operation, or to attempt to gain unauthorised access to any part of it or to the server it runs on;
- to disguise or misrepresent who you are, or to submit an enquiry on behalf of someone else without their agreement;
- to scrape or systematically copy the content for republication.
We may restrict or block access where we reasonably believe this is necessary to protect the website, other visitors, or personal data.
6. Links to other websites
This website may link to websites we do not control. A link is provided for convenience and does not mean we endorse the other site or have any responsibility for it. We do not control its content, its privacy practices or its availability, and we are not liable for any loss arising from your use of it. If you find a link that is broken or misleading, please tell us.
7. Availability and changes
We keep the website running and may change it from time to time — adding pages, correcting wording, improving the design or retiring a feature. We try not to break anything in the middle of a conversation, but we cannot guarantee that the site will always be available, always be up to date, or never contain an error. We may also withdraw the Vision builder or any other feature.
Nothing on this website is a guarantee of future work, of availability of any service, or of any particular result. Any statement about outcomes is an illustration of how ARTinez works, not a commitment.
8. Your statutory rights
Nothing in these terms excludes or limits any right you have under consumer law, or any other right that cannot lawfully be excluded. In particular, if you are a consumer, the terms that apply to any contract for services you enter into are the Service Terms and Conditions, and your cancellation rights are set out in the Consumer Cancellation and Refund Information.
These terms do not remove the requirement that ARTinez acts with reasonable care and skill in providing services. Where a term here conflicts with a provision of consumer law that cannot be excluded, that provision prevails.
9. Liability
To the extent the law allows, ARTinez is not responsible for loss arising from your use of, or your inability to use, this website, other than as set out below. This includes any loss of profit, business, data or goodwill, and any loss caused by a business decision you took in reliance on the content of the website.
The website is provided on an "as is" and "as available" basis. We take care to keep it accurate, but we do not warrant that it is error-free, uninterrupted, or fit for a particular purpose.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Where you are a consumer, we are also responsible for loss that is a foreseeable consequence of our breach of these terms or of failing to use reasonable care and skill.
10. Third-party content
This website uses three open-source typefaces — Cormorant Garamond, Inter and Dancing Script — published under the SIL Open Font License 1.1, and one illustrative stock photograph. Both remain the property of their owners and are used under their own terms. We host them ourselves rather than loading them from a third-party CDN, and we record the source and licence of each on the site. If you download, copy or reuse them, you do so under those terms, not ours.
11. Changes to these terms
We may update these terms. The version number and effective date at the top of this page show the current version. If a change is material we will say so on the home page for at least 30 days. Your continued use of the website after a change means you accept the updated terms. If you do not accept them, please stop using the website and contact us.
12. Governing law and jurisdiction
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them.
If you are a consumer, this does not affect your right to bring proceedings in the courts of the place where you live. If you live in Scotland or Northern Ireland, you may also bring proceedings there. Nothing in these terms requires you to bring proceedings in England and Wales, or prevents you from using any other remedy available to you.
